At Color Girl Miami, we are committed to protecting your privacy and personal information. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website, book our services, or interact with us.

1. Information We Collect

Personal Information

We may collect the following personal information:

  • Contact Information: Name, email address, phone number, mailing address
  • Booking Information: Service preferences, appointment dates and times, special requests
  • Payment Information: Credit card details, billing address (processed securely through third-party payment processors)
  • Communication Records: Messages, emails, and other communications with us
  • In-App Support: A bug report or question you choose to send, attached by our server to your verified account email and selected Color Girl profile. We also attach the app surface and view, version and build when available, locale, and basic device/browser information so we can investigate. The support form does not attach photos, screenshots, questionnaire answers, color-result content, or full page URLs.
  • Marketing Preferences: Subscription preferences for newsletters and promotional materials
  • Color Girl App Profile: Your questionnaire answers, selected budget and shopping preferences, saved colors and products, estimated or confirmed color season, app access status, private photo-history metadata, and consent records
  • App Access and Activity: We maintain private invitation-send records, verified account-access timestamps, and limited feature-use events such as opening your palette or visiting Shop. These records help us support access and understand which features are useful. These activity events do not contain photos, report contents, login codes, or free-text inputs.

Photos and AI Features

The Color Girl App includes optional photo-based features. These features work only after you choose a photo and provide the consent shown in the app. When you request an AI photo feature, the disclosed photos and limited context are sent to OpenAI for processing. Color Girl requests processing with response storage disabled and does not allow OpenAI to use API data to train its models by default. Under OpenAI’s standard API data controls, submitted content may be retained in abuse-monitoring logs for up to 30 days and may be retained longer when required for safety or legal reasons. Private photos that you separately ask Color Girl to retain in your account are stored by Color Girl, not as OpenAI response history.

  • AI color analysis: Prepared versions of your three guided photos and limited questionnaire context are sent to OpenAI for the estimate you request. We store the structured analysis and internal quality diagnostics in your Color Girl account. Color Girl does not save the three source photos as analysis-photo history. OpenAI may retain the submitted API content for the monitoring period described above. A separate retained-photo feature, such as Hair Edit, asks for its own purpose-specific consent.
  • Optional season portrait (“face in your colors”): In the Color Girl iPhone app, Apple’s on-device Vision technology checks the framing and removes the background locally when you choose a photo for your season portrait. The original selfie stays on your device and is not uploaded or saved by Color Girl; only the prepared transparent portrait is uploaded to your selected Color Girl profile. On the web, OpenAI checks whether the selfie is suitable and remove.bg removes its background through our server when you choose a photo for your season portrait. The original web selfie is processed transiently and is not retained by Color Girl. You can adjust the prepared portrait in a season-color bubble before saving it. On either platform, the prepared portrait is stored privately so your face remains available in your season bubbles and your selfie library until you delete it or delete that app profile. Saving a new portrait keeps your previous saved portraits available in the library.
  • Hair Edit: When you choose a saved analysis photo or upload a new Hair Edit photo, Color Girl stores that photo privately so we can create, preserve, and display your Hair Edit. Replaced photos may remain in your private account history. Only the signed-in client and authorized Color Girl staff can access these files through short-lived secure links.
  • On-device color check: Garment color sampling is performed in your browser and the garment photo is not uploaded to Color Girl.

AI color results are estimates and are not the same as a Paige-confirmed personal color analysis. You can choose not to use photo-based AI features and continue using the app’s non-photo features.

Website Usage Information

We automatically collect certain information when you visit our website:

  • Device Information: IP address, browser type, operating system
  • Usage Data: Pages visited, time spent on site, referral sources
  • Cookies: Small data files stored on your device to enhance your browsing experience

The private Color Girl App does not load our advertising pixels or general website analytics. On the clean app intake route, we use Microsoft Clarity in cookieless, fully masked mode to understand anonymous completion and drop-off at each step. Clarity receives only generic stage events such as “question 3 viewed” or “question 3 completed”; it does not receive questionnaire answers, photos, email addresses, color results, selected plans, profile links, or checkout-return details. We also use a first-party, session-only identifier to connect generic page and funnel activity to a completed Stripe purchase. This identifier is cryptographically signed, remains in session storage, honors Global Privacy Control and Do Not Track, and is not a device fingerprint. The attribution record excludes names, email addresses, photos, questionnaire answers, full URLs, and URL query strings. Anonymous funnel touchpoints are deleted after 13 months; verified payment records may be retained as required for financial, tax, fraud-prevention, and legal obligations. Authentication and essential security services may still process technical request information needed to sign you in and protect the service.

2. How We Use Your Information

We use your personal information for the following purposes:

  • Service Delivery: To provide color analysis services, process bookings, and communicate about appointments
  • Payment Processing: To process payments and manage billing
  • Customer Support: To respond to your inquiries and provide customer service
  • Marketing Communications: To send newsletters, promotional offers, and updates about our services (with your consent)
  • Website Improvement: To analyze website usage and improve our online experience
  • App Personalization: To show your color palette and rank fashion and beauty recommendations using your season, budget, audience, goals, and confidence preferences
  • AI Requests: To provide an optional color estimate or Hair Edit that you explicitly request
  • Legal Compliance: To comply with applicable laws and regulations

3. Information Sharing and Disclosure

We do not sell, trade, or rent your personal information to third parties. We may share your information in the following limited circumstances:

  • Service Providers: With trusted third-party vendors who assist us in operating our website, conducting business, or serving you (e.g., identity, hosting, database, AI, payment, analytics, and email providers)
  • Legal Requirements: When required by law, court order, or government regulation
  • Business Protection: To protect our rights, property, or safety, or that of our clients or others
  • Business Transfers: In connection with any merger, sale of company assets, or acquisition

4. Data Security

Shop analytics: For invited adults, Microsoft Clarity automatically records masked clicks and scrolling while the Shop view is open. Text and images are masked, analytics and advertising cookies remain disabled, and we do not send customer names, email addresses, or account identifiers as analytics labels. Recording stops when you leave Shop and is not enabled on report, photo, account, login, or checkout views. Browser Global Privacy Control and Do Not Track signals also keep it off. Microsoft’s privacy statement describes its processing.

We implement appropriate technical and organizational security measures to protect your personal information against unauthorized access, alteration, disclosure, or destruction. These measures include:

  • Secure Socket Layer (SSL) encryption for data transmission
  • Secure storage of personal information on protected servers
  • Limited access to personal information on a need-to-know basis
  • Regular security assessments and updates

However, no method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security.

Signed-in Color Girl App customers can download or delete their saved app profile directly from the Privacy & Data section of the app. In the iPhone app, choosing Delete my account also removes the app login identity after confirmation.   • Affiliate Commerce: Approved affiliate networks and merchants when you choose an eligible shopping link

Shopping links may be affiliate links. Color Girl may earn a commission when you buy through an eligible link, at no extra cost to you. These third parties have their own privacy policies, and we encourage you to review them.

8. Data Retention

We retain your personal information for as long as necessary to provide our services and comply with legal obligations. Specifically:

  • Client Records: Maintained for the duration of our business relationship and up to 7 years thereafter for legal compliance
  • Marketing Data: Retained until you opt out or request deletion
  • Website Analytics: Aggregated data may be retained indefinitely for business analysis
  • Unfinished Color Girl App session: Questionnaire drafts and anonymous favorites are kept only in browser session storage, expire within 24 hours, and are cleared when you reset the app. They are not written to persistent browser storage.
  • Color Girl App profile: Questionnaire answers, saved items, access records, structured color results, and consent records are retained while your account is active. Inactive basic profiles that are not linked to a client or payment account are automatically deleted after 24 months.
  • Private Hair Edit photos: Photos you consent to save for Hair Edit, including replaced source photos, are retained in your private app photo history while your account remains active or until your Color Girl App data is deleted. Deleting your app data removes these private files and their app records, subject to legal requirements.
  • Prepared season portrait: The original season selfie is not retained by Color Girl. The transparent portrait prepared from it is retained privately in the selected Color Girl profile and your selfie library until you delete it or delete that app profile. Saving a new portrait keeps your previous saved portraits available in the library.
  • In-app support tickets: Support messages and their bounded account, profile, and technical context are deleted after 24 months.
  • OpenAI photo processing: Color Girl sends requests with response storage disabled and does not save source analysis photos. OpenAI may retain submitted API content in abuse-monitoring logs for up to 30 days and may retain content longer when required for safety or legal reasons.
  • Affiliate attribution: App affiliate-click records are deleted after 13 months.
  • Security limits: App request-limit records are deleted after 7 days.
  • Payment and legal records: Stripe transaction records and records we must retain for tax, fraud prevention, dispute, or other legal purposes are kept separately for the required period and are not removed by the in-app profile deletion control.

9. Children's Privacy

Our services are not intended for individuals under 18 years of age. We do not knowingly collect personal information from children under 18. If we become aware that we have collected personal information from a child under 18, we will take steps to delete such information.

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or applicable laws. We will notify you of any material changes by:

  • Posting the updated policy on our website
  • Sending an email notification to registered users
  • Updating the "Last Updated" date at the top of this policy
